摘　　要：《民法典》对公序良俗的确认,主要体现为对“公序良俗原则”的内在规定,为其他领域立法法典化提供范例。《民法典》是公民生活的“百科全书”,开启了公民权利保护的新时代。公序良俗是公共秩序和善良风俗的统称,公序良俗的法治价值是对法治社会的支撑。公序良俗是《民法典》人权精神的价值体现,需要构建公序良俗价值追求上的民法体系。“公序良俗原则”在司法实践中的适用,包括坚持《民法典》规范的类推适用,实施公序良俗认罪认罚从宽制度,遵循公序良俗与法治融合的原则,发挥公序良俗在乡村治理中的功能作用。The confirmation of public order and good custom in the Civil Code mainly includes the internal provisions of the principle of“public order and good custom”,which provides examples for the codification of legislation in other fields.The Civil Code is the“encyclopedia”of civil life and opens a new era of civil rights protection.Public order and good custom is the general term of public order and good custom.The value of public order and good custom is the support for the society ruled by law.Public order and good custom reflects the value of the human rights spirit of the Civil Code.It is necessary to construct the civil law system on the value pursuit of public order and good custom.The application of the principle of public order and good custom in judicial practice includes adhering to the analogical application of the norms of the Civil Code,implementing the system of leniency for pleading guilty according to public order and good custom,following the principle of the integration of public order and good custom with the rule of law,and giving play to the function of public order and good customs in rural governance.
