摘　　要：动物福利是指为动物创设一定的环境条件,满足它们的基本生存需求。随着我国生态文明建设的新发展,关于动物福利制度及其立法的问题日益引起社会的广泛关注。而我国在这一层面依旧存在空白。本文通过梳理国外动物福利立法的发展历史,并与国内现有的动物福利相关的法律法规进行比较,以明确保护动物福利的立法目的、扩大动物福利的范围、建立健全公众参与制度等,为完善我国动物福利立法提供思路与启示,以促进新时期生态文明建设的发展。Animal welfare refers to the creation of certain environmental conditions for animals to meet their basic living needs. With the new development of ecological civilization construction in China, the issues of animal welfare system and its legislation are attracting increasing attention of the society. However, there is still a large gap in this aspect in China. By sorting out the historical context of the development of animal welfare legislation in foreign countries and comparing it with existing laws and regulations related to animal welfare in China, this paper analyzes the reference points, such as clarifying legislative purposes of animal welfare protection, expanding the scope of animal welfare, establishing and improving the public participation system, etc, so as to provide ideas and inspiration to improve the animal welfare legislation in China, and promote the development of ecological civilization construction in the new period.
