摘　　要：桂西北少数民族习惯规则作为在少数民族社会中的一种自发形成的约束准则,具有规范创制、秩序维护、司法保障等多种功能,是集中体现少数民族传统文化的重要载体。近现代以来,随着“国家在场”因素对桂西北地区的影响,桂西北少数民族习惯规则曾一度被“边缘化”,但作为一种内生性的民族法治文化形态,其自身也在适应着外界环境的变化。通过对H自治县少数民族习惯规则的田野调查,发现桂西北少数民族习惯规则在“国家在场”语境下并未消失,而是实现了“载体”再造、“理念”重构和“传承”更新。在桂西北少数民族习惯规则的未来发展层面上,应以新时代为话语背景,培育一种以“差序法治”为表征的双向格局,并积极建构少数民族传统法治与现代法治之间的良性互动机制,培育少数民族习惯规则的新型生存场域。As a criterion spontaneously formed in the minority society, the minority customary law in Northwest Guangxi has many functions, such as norm creation, order maintenance, judicial guarantee and so on. It is an important carrier to embody the traditional culture of ethnic minorities. Since modern times, with the influence of "state presence" on Northwest Guangxi, the customary law of ethnic minorities in Northwest Guangxi has once been "marginalized";However, as an endogenous cultural form of national rule of law, it is also adapting to the changes of the external environment. Through the field investigation of Yao traditional sports in H Autonomous County, it is found that the customary law of ethnic minorities in Northwest Guangxi has not disappeared in the context of "state presence", but has realized the reconstruction of "carrier", "concept" and "inheritance". In terms of the future development of minority customary law in Northwest Guangxi, we should take the new era as the discourse background, cultivate a two-way pattern characterized by "differential order rule of law",actively construct a benign interaction mechanism between minority traditional rule of law and modern rule of law, and cultivate a new survival field of minority customary law.
