摘 要:在鼓励开发利用地下空间的背景下,囿于中央立法的模糊性与抽象性,地方开展地下空间确权工作缺乏共享经验与统一指导,致使地下空间确权登记工作推进缓慢,其中尤以地下车位为甚。在现行规范体系内,地下空间确权登记存在较大的立法空白,实践中也暴露出同案不同判、一地一策等问题。问题的核心在于地下建设空间使用权的独立性、地下停车位的权利归属以及“首先满足业主的需要”的规范内涵在法律意义上不明确。在改革过程中,地下空间的确权必须基于类型化定性,对“首先满足业主的需要”予以法律解释,同时与不动产登记制度进行统合与衔接。Under the background of encouraging the development and utilization of underground space,the local authorities,limited by the ambiguity and abstraction of the legislation,lack shared experience and unified guidance in the confirmation of the rights of underground space,which slows down the confirmation and registration of the rights of underground space.Disputes over the ownership of underground parking space are the most typical.In the current legal system,there are legislative blanks in the confirmation and registration of underground space rights.In practice,similar cases may have different judgments,and policies vary from region to region.At present,there are three core legal concepts that need to be clarified urgently:the independence of the right to use the underground construction space,the ownership of the underground parking space,and the normative connotation of“meeting the needs of the owners first”.In the process of reform,it is necessary to carry out typed qualitative confirmation of underground space,to provide legal interpretation for“meeting the needs of the owners first”,and to integrate and link with the real estate registration system.
