摘　　要：当下,政府开始大力解决环境问题,但是传统的财政资助计划往往无法满足环境问题治理的资金需求。而且在传统资助模式下,政府为环境问题治理提供资金,通常以“赠款”的形式进行,无论结果是否实现,都会支付资金,政府将承担治理失败带来的财政损失。就上述问题而言,环境效益债券是可供选择的解决方案之一,其利用社会资本治理环境问题,政府为环境问题治理的可验证结果付费,其中项目风险由投资者承担。通过分析发现,我国已经有实施环境效益债券的需要和基础,当下最重要的是分析和论证如何进行环境效益债券的本土改造及其法治进路构建。At present,the chinese government has begun to strongly support addressing environmental issues,but the traditional financial aid programs often fail to meet the financial needs of environmental governance.Under the traditional funding model,the government usually provides funds for environmental governance in the form of“grants”regardless of the results,which is subject to potential financial losses caused by governance failure.As far as these problems are concerned,adopting environmental impact bond is an alternative solution.It uses social capital to solve environmental problems,and the government pays for verifiable results of environmental governance in which project risks are borne by investors.The investigation shows that China has such a need and a basis for implementing environmental impact bond,and the most urgent thing at present is to explore how to localize environmental impact bond and construct its legalization.
