摘　　要：航运业作为海洋经济的重要组成部分,为国家“一带一路”倡议的推进提供了坚实保障。在剖析并购反垄断豁免制度的价值理念与规则表达的基础上,探析航运反垄断豁免规则的理论体系,从而厘清我国反垄断监管思路,找寻反垄断立法和执法上的不足。从P3联盟案例的执法实践经验中可以获得完善我国航运反垄断豁免制度的重要启示:其一,完善反垄断法律制度,弥补国际航运业反垄断规制的立法缺漏;其二,尽快出台《航运法》,构建符合我国国情的航运反垄断豁免规则体系;其三,科学界定紧密型联盟与松散型联盟,分别构建适用“经营者集中”和“垄断协议”的反垄断规制路径。As an important part of the marine economy,the shipping industry provides a solid guarantee for the promotion of the national“The Belt and Road”initiative.On the basis of analyzing the value concept and rule expression of the anti-monopoly exemption system for mergers and acquisitions,this paper analyzes the theoretical system of the anti-monopoly exemption rules for shipping,so as to clarify the ideas of China’s anti-monopoly supervision and find out the deficiencies in anti-monopoly legislation and law enforcement.From the practical experience of P3 alliance case,we can get important enlightenment to improve China’s shipping anti-monopoly exemption system:firstly,improve the anti-monopoly legal system to make up for the legislative gaps in the anti-monopoly regulation of the international shipping industry;secondly,The Shipping Law should be promulgated as soon as possible to build a shipping anti-monopoly exemption rule system in line with China’s national conditions;thirdly,scientifically define the close alliance and the loose alliance,and construct the anti-monopoly regulation path applicable to“concentration of business operators”and“monopoly agreement”respectively.
