摘　　要：产品型服装和艺术品型服装的分化使服装的价值内涵更加丰富,即产品型服装主要突出其经济价值载体的功能,而艺术品型服装则更加突出其文化价值载体的功能。作为文化价值载体的艺术品型服装关键在于创新,而只有保护创新才能促进艺术品型服装的发展,并进一步推动服装文化的传播和发展。习近平总书记指出,“保护知识产权就是保护创新”。《著作权法》是知识产权制度体系中保护和促进文化创新的重要法律。就艺术品型服装而言应当肯定其著作权客体的法律地位,提炼其著作权客体的认定标准,在此基础上给予其著作权法的保护。The differentiation of product clothing and art clothing enriches the value connotation of clothing,that is,product clothing more prominent its economic value carrier function,while art clothing more prominent its cultural value carrier function.As the carrier of cultural value,the key of art-style clothing lies in innovation,and the protection of innovation can promote the development of art-style clothing,and further promote the spread and development of clothing culture.General secretary Xi Jinping has pointed out that"protecting intellectual property rights is protecting innovation".Copyright law is an important system to protect and promote cultural innovation in intellectual property system.In terms of art-type clothing,the legal status of the object of copyright should be affirmed,the identification standard of the object of copyright should be refined,and the protection of copyright law should be given on this basis.
