人类命运共同体理念的文化底色及其国际法意涵

摘　　要：当前,国际社会面临百年未有之大变局并正经受严峻疫情考验,国际关系中逐步呈现的逆全球化浪潮,对开展多边主义国际合作造成极大消极影响。人类命运共同体理念是中国为国际社会提供的具有中国特色并脱胎于传统经典文化的公共产品。其中,包含了丰富的国际法理念,符合联合国宪章精神,并与西方传统经典哲学中的“共同同意”自然法原则存在一定程度的契合。人类命运共同体所蕴含的持久和平、普遍安全、共同繁荣、文明共存和可持续发展等原则,与国际法原则相辅相成,可视为中国对国际法体系的新贡献。因此,将现行国际法基本原则与人类命运共同体理念融为一体并不必然导致中西方文明冲突,而将丰富与充实现行国际法原则体系,同时也将为中国参与全球治理,使得国际秩序朝着有利于全人类共同利益的方向规范发展作出贡献。At present, the international community is facing profound changes unseen in a century and is undergoing severe tests of the epidemic. The trend of anti-globalization in international relations has exerted a great negative impact on multilateral international cooperation. The concept of the community of human destiny proposed for the international community by China is a public product with Chinese characteristics and derived from traditional classical culture, which contains rich concepts of international law, is in line with the spirit of the UN Charter, and has a certain degree of compatibility with the natural law principle of “mutual consent” in traditional western classical philosophy. The principles of lasting peace, universal security, common prosperity, coexistence of civilizations and sustainable development embodied in a community with a shared future for mankind complement the principles of international law and can be seen as China’s new contribution to the system of international law. Therefore, the current international law basic principle combined with human destiny community concept does not necessarily result in conflict between Chinese and western civilization, but it will enrich the current international law system. Meanwhile it will also contribute to China’s participation in global governance and the normative development of the international order in the direction of the common interests of all mankind.
