摘　　要：海关是《生物安全法》的执法主体之一。该法第二十三条、二十四条和第二十七条明确规定了海关在执行此法时的部分职责在生物安全领域。《生物安全法》与《进出境动植物检疫法》等是母法与子法、一般法与特别法的关系。本文从生物安全领域尤其是动植物检疫领域基本概念等入手,就《生物安全法》的立法背景及重要内容与国外生物安全法律法规及我国进出境动植物检疫相关法律法规进行比较研究,根据法律要求及比较研究结果对海关动植物检疫工作提出建议。The customs is one of the main enforcement bodies of the Biosecurity Law.Articles 23,24 and 27 of the Law specify that part of the duties of the customs in the implementation of this law are in the field of biosafety.The biosecurity Law and the Entry and exit Animal and Plant Quarantine Law are related to mother law and child law,general law and special law.Starting from the basic concepts in the field of biosafety,especially in the field of animal and plant quarantine,this paper makes a comparative study on the legislative background and important contents of the Biosafety Law and foreign laws and regulations,and puts forward suggestions on the work of customs mobile plant inspection according to the legal requirements and comparative research results.
