我国体育经纪人法律规制研究  

A Research on the Laws and Regulations on Sports Agent in China

摘　　要：我国暂无统一的体育经纪人管理办法,现有单项体育协会出台的体育经纪人管理办法不具有普适性,体育经纪行业存在合同规范化程度低、对体育经纪人信用监管不足、体育经纪纠纷解决机制不完善等问题,体育经纪行业迅速发展与体育经纪法律规制不完善的矛盾日益凸显。通过梳理美国、日本和国际体育联盟有关体育经纪人的法律规制,提出由国家相关部委联合出台统一的《体育经纪人管理办法》,成立行业自律组织,规范体育经纪合同,加强从业人员诚信监管,引入职业保险制度,完善体育经纪纠纷解决方式等措施优化我国体育经纪人法律规制,为进一步挖掘体育产业潜力、完善职业体育治理体系提供参考。There are no unified laws and regulations on sports agents in China,and regulations issued by a specif-ic sports association are not universal.There is an emerging contradiction between the rapid development of the sports a-gent industry and the imperfection of laws and regulations on sports agents because of the low degree of contract stand-ardization,insufficient credit supervision on sports agents and insufficient solutions to sports agency disputes.By com-bing laws and regulations on sports agents made by the United States,Japan and international sports leagues,the paper puts forward that a unified Administrative Measures on Sports Agents should be enacted jointly by relevant ministries and commissions of the state and self-regulatory organizations be set up to optimize the laws and regulations on sports a-gents by means of strengthening the management of sports agency contracts,enhancing the integrity supervision of prac-titioners,introducing occupational insurance systems,improving sports agency disputes'solutions and so on,which can provide references for further tapping the potential of the sports industry and improving the management system of pro-fessional sports.
