摘 要:随着《市场准入负面清单(2020年版)》的公布,负面清单制度为建设服务型政府进一步“提速”。这场清单治理实践如何响应服务型政府建设的号召?二者之间存在怎样的内在逻辑关系?实现路径如何?这些都亟待从学理上予以解决。通过辨析推行负面清单制度与建设服务型政府在逻辑层面和路径层面所具有的内在逻辑关系,以监督机制、法律法规、政府职能等方面为抓手,分析现阶段所面临的现实困境,并对二者的实现路径予以政策建议。厘清负面清单制度与服务型政府二者之间的内在契合关系,既有利于深化“放管服”改革,激发市场主体活力,改善和优化营商环境,又有利于推动政府职能转变,加快人民满意的服务型政府建设。with the release of the negative list of market access (2020 Edition),the negative list system has further "accelerated" the construction of a service-oriented government.How does this list governance practice respond to the call of building a service-oriented government?What is the internal logical relationship between the two?How to implement the implementation path?It is urgent to be solved theoretically.By analyzing the internal logical relationship between the implementation of the negative list system and the construction of a service-oriented government at the logical level and the path level,and taking the supervision mechanism,laws and regulations,government functions and other aspects as the starting point,this paper analyzes the practical difficulties faced at this stage,and gives policy suggestions on the realization path of the two.Clarifying the internal correspondence between the negative list system and the service-oriented government is not only conducive to deepening the reform of "simplification,decentralization,optimization",stimulating the vitality of market players,improving and optimizing the business environment,but also conducive to promoting the profound transformation of government functions and accelerating the construction of a service-oriented government to the satisfaction of the people.
