论“司考”改“法考”与法学教育发展——《司考十年反思录》再思考

摘　　要：《司考十年反思录》一书以武汉市作为研究基础,对2002年至2011年的司法考试情况进行了极为细致的分析,深刻地揭露出司法考试的相关缺陷,并结合国外情况给出了较为合理的建议。直到2017年末代司法考试末年,书中提到的有些问题得到了解决,而有些问题则变本加厉。2018年法律职业资格考试初年相较于司法考试确实称得上一次变革,无论是考题类型、考试资格和考试次数等都发生了变化。在肯定进步的同时,我们也要注意到,法律职业资格考试不仅改变了法律职业人才培养的选拔方式,也改变了我国的法学教育。这种改变是否积极,在仔细分析和预测之后,只能由时间来检验。The book,Ten Years'Reflections on Judicial Professional Qualification Examination,takes Wuhan City as the research foundation,and carries out a very detailed analysis of the judicial examination situation from 2002 to 2011,which profoundly reveals the related defects of the judicial examination,and presents the sound suggestions with the consideration of the counterpart examinations in foreign countries.The Judicial Professional Qualification Examination lasted until the end of 2017,when some of the problems mentioned in the book were solved,and some problems became even worse.Meanwhile,the first legal professional qualification examination started at the beginning of 2018,which is considered not only as a transmutation but also a reform comparing with its predecessor.There are many changes in the types of examination questions,examination qualifications and examination times.While affirming the progress mentioned above,we should also noticed that the legal examination has not only changed the selection method of legal professional cultivation,but also changed China's legal education.Whether this change is positive or not can only be tested by time with careful analyses and prudent prediction.
