论监察留置与刑事强制措施的有效衔接  

On the Effective Connection Between Supervisory Detention and Criminal Compulsory Measures

摘　　要：监察留置与刑事强制措施的有效衔接是保障职务犯罪案件诉讼程序顺利进行的必然要求,契合了国家法治反腐的大方向。但在衔接中不可避免地存在一些问题,留置措施天然具有封闭性,对被调查人的相关权益保障不充分,留置措施与刑事强制措施之间衔接不自然,且程序倒流的衔接缺乏规范的指引。为了解决这些问题,需要加强检察机关的外部监督职能以及对被调查人的权利保障,建立起阶梯式的监察强制措施体系,采用“人案全退”原则解决现在程序倒流衔接上存在的弊端。The effective connection between supervisory detention and criminal compulsory measures is an inevitable requirement to ensure the smooth proceeding of the litigation procedure of duty crime cases,which accords with the general direction of the national rule of law and anti-corruption. However, there are inevitably some problems in the connection. For example, the nature of the retention measure is closed, the protection of the human rights of the investigated person is insufficient, there are conflicts between the retention measure and criminal compulsory measure, and the connection of procedure reversal is lacking in normative guidance. In order to solve these problems, it is necessary to strengthen the external supervision function of the procuratorial organ and the protection of the rights of the people under investigation, establish a stepwise supervision system of compulsory measures,and adopt the principle of“all the people involved in the case withdraw”to solve the defects existing in the connection of the current procedure reversal.
