摘 要:相对于机构服务来说,上门医疗和护理服务对服务质量和风险管控的要求更高,需要有完备的法律体系和监管体系作为支撑。因此,政府部门要完善居家医养结合中的相关法律规范,明确“医”和“养”的服务范围,界定医疗和养老供给方的权责与义务、利益关系、服务内容、风险管控机制等,制定居家医养服务合同范本,这也有利于更好地监管服务过程,有效地规范市场运行,在发现风险和处理风险的过程中有法可依、有章可循。Compared with institutional services,door-to-door medical and nursing services have higher requirements on service quality and risk control,and require a complete legal system and regulatory system as support.Therefore,government departments should improve the relevant legal norms in theintegration of home-based medical care,clarify the scope of“medical”and“nursing”services,and define the rights,responsibilities and obligations,interest relationships,service content,and risk management and control mechanisms of medical and elderly care providers,formulate a model contract of home-based medical care service,which is also conducive to better supervising the service process,effectively regulating the operation of the market,and having laws and regulations to follow in the process of discovering and dealing with risks.
