基于介入系统的法庭调解话语博弈策略研究

摘　　要：法庭调解的过程就是调解法官通过话语协商、不断介入双方当事人的纠纷、化解冲突并不断协调人际关系的过程。本研究以离婚诉讼法庭调解的真实语料,基于介入系统的视角,采用定量、定性相结合的研究方法,探究法庭调解法官是如何使用介入资源与原、被告进行调解话语博弈,推动法庭调解有效进行。研究表明,调解法官通常较多地使用接纳介入资源来拓展与原、被告协商的会话空间;而在推进纠纷协商时较多地使用否定介入资源来紧缩原、被告话语空间以实现法庭调解“案结事了”。语料分析显示,调解法官倾向于使用接纳资源,尽量避免使用绝对、否定资源来拓展调解话语协商空间;频繁采用收缩资源或单声性话语则会限制双方当事人的观点,从而导致调解互动会话空间收缩。基于对法庭调解话语介入的博弈策略分析,本研究旨在为法庭调解话语博弈提供可行的借鉴和启示,以期推动法庭调解的顺利进行。Court-related mediation is a process of discursive negotiation and constant engagement in both sides’ disputants’ conflict disputes with the mediation judges’ mediation of both sides’ disputants’ interactional relations. From the perspective of Engagement System, based on the authentic divorce mediation data, this paper makes a tentative study with the qualitative and quantitative approaches to explore how court-related judges exploit the engagement resources to engage in the negotiation with both sides’ disputants towards the process of dispute-resolution. The results show that court-related judges frequently exploit more of the entertain resources and less of disclaim ones to expand mediation space and adopt more of disclaim resources to contract the disputants’ mediation space towards the fulfillment of dispute-resolution. Data analysis demonstrates that entertain resources are adopted and totally-denied disclaim resources are ignored in Court-related mediation, which expands the mediation space. Otherwise, mediation spaces are constricted by extremely emphasizing one’s monogloss or disclaiming engagement resources, which is sure to restrict other sides’ mediation pursuits. This paper aims to explore how the mediation judges make full use of the engagement resources to negotiate effectively with both sides’ disputants so as to push forward the dispute-resolution smoothly.
