利用汽车行驶记录仪视频资料对事故中车辆行驶速度进行司法鉴定案例分析

摘　　要：在交通事故案件中,通过车辆行驶速度认定事故参与者的事故责任大小的权重比较大,从委托人提供的各种鉴定材料相关证据分析判断出事故车辆在采取避让措施时的行驶速度比确定发生事故瞬间车辆行驶速度更客观和更有价值。对车辆速度鉴定的现行标准、方法很多,而每一个案件都有其独特性,不是任何一种车速鉴定的方法都能恰当、准确、科学地鉴定出车辆事故中采取避让措施时的行驶速度。在其他证据不具备鉴定条件时,利用汽车行驶记录仪视频资料鉴定车辆事故中采取避让措施时行驶速度是一种很有效的鉴定方法。现通过具体案例论述如何用汽车行驶记录仪视频资料来鉴定车辆事故时行驶速度。In a traffi c accident case,the vehicle speed is used to determine the accident responsibility of the accident participants.From the analysis of the relevant evidence of various identifi cation materials provided by the client,it is judged that the speed of the accident vehicle when taking evasive measures is higher than that of the accident vehicle.It is more objective and valuable to determine the speed of the vehicle at the moment of the accident.There are many existing standards and methods for vehicle speed identifi cation,and each case has its own uniqueness.Not any method of vehicle speed identifi cation can properly,accurately and scientifi cally identify the driving speed when evasive measures are taken in a vehicle accident.When other evidence does not meet the identifi cation conditions,it is a very eff ective identifi cation method to use the video data of the car driving recorder to identify the driving speed when taking avoidance measures in a vehicle accident.Now the article through a specifi c case discusses how to use the video data of the car tachograph to identify the speed of the vehicle in the event of an accident.
