摘　　要：文章以图书馆权利为研究对象,探讨在重大突发公共事件背景下,限制图书馆权利的正当性及限制的内容与界限,以及受限制图书馆权利的保障与救济等主要法律问题。其对我国图书馆法治的影响及借鉴为:在尊重与保障人权视角下关注图书馆权利,丰富图书馆权利的自由与平等价值内涵;分析图书馆权利的限制依据、主体、程度、程序等限制界限,考察图书馆权利的保障原则与救济手段,从而以法律原则与法律制度为手段确认和落实图书馆权利的限制与保障。This article takes the library rights as the research object, discusses the legitimacy of restricting library rights as well as the content and definition of limitation, the protection and relief of restricted library rights and so on under the background of major public emergency. Its influence and reference on the rule of law in libraries in China are as follows: paying attention to library rights from the perspective of respecting and protecting human rights, enriching the value connotation of freedom and equality of library rights;analyzing the limitations of library rights, such as the basis, subject, degree and procedure, and investigating the protection principles and remedies of library rights, so as to confirm and implement the limitation and protection of library rights by means of legal principles and legal systems.
