摘　　要：进入新发展阶段,专利工作的发展方向从注重数量增长向提升质量和价值转变。专利质量不仅反映为申请专利的技术创新水平,也反映为授权专利能否全面制止他人使用说明书公开的技术方案的行为的发生。专利质量问题是一国知识产权保护和运用中的特定问题,是一个具有国情特色的政策制度问题。有利于科技成果转化的专利质量评价不仅是研究专利质量的影响因素,更是在强化知识产权保护和运用中为回应和明确知识产权制度实施中的问题,建立一个基于专利权保护范围的专利质量评价体系。通过分析专利基本制度及运行的基本规律,论证应然状态下通过分析权利求宽度评价技术创新水平的科学性,以及通过技术效果阶梯层次评价权利要求撰写水平的规范性,综合评价技术创新水平和权利要求撰写水平,建立基于专利权保护范围的专利质量评价框架。After China has entered a new stage of development, direction of the patent work is transforming from the pursuit of quantity to the improvement of quality.Patent quality is manifested not only in the level of technological innovation in the patent applied for but also in the ability of the authorized patent to completely prevent others from using the technical scheme disclosed in the description.As a specific issue in the protection and application of intellectual property rights in a country, patent quality is an institutional and policy issue with national characteristics.The research on patent quality analysis to promote the transformation of scientific and technological achievements not only to study the influencing factors of patent quality;In fact, it is to establish a patent quality analysis system based on the scope of patent protection to respond to and solve the problems in the implementation of intellectual property system in the process of strengthening the protection and application of intellectual property.Through the basic system of patent law and the fundamental operation rules, in this paper, it demonstrates the scientific Ty of analyzing the level of technological innovation through the breadth of claims under the condition of necessity, the standardization of analyzing the level of claim writing through the ladder level of technological effect, and the comprehensive analysis of the level of technological innovation and the level of claim writing, and then establish a patent quality analysis system based on the scope of patent protection.
