中国乡村纠纷公益调解机制的构建

摘　　要：乡村纠纷案件数量不断增长和纠纷解决难度加大,是目前客观存在的难题。究其原因,一是以乡干部和村委成员为主的调解人精力有限、力不从心;二是村民对于司法途径解决纠纷不了解、不积极,对于纠纷案件解决的结果预期不确定。构建乡村纠纷公益调解机制,一是选聘各类人才作为调解人,以克服知识专业性和经验有限性之不足;二是及时对接纠纷案件与相应的调解人,通过建立乡村纠纷调解平台、各类专业调解人名册、乡村纠纷案件类型清单表,形成动态的纠纷调解运行系统,及时解决日益多样复杂的乡村纠纷;三是明确公益性,通过减少村民支出负担、节省时间和精力、提高村民预期,使公益调解成为村民解决纠纷的优先选择。The increasing number of rural dispute cases and the increasing difficulty of dispute resolution are real problems at present.The reasons are as follows:firstly,the mediators,mainly composed of township cadres and CPC committee members in villages,have limited energy and capacities to handle them;secondly,the villagers do not understand the relevant laws and are not active in solving disputes through judicial channels,and they are uncertain about the outcome of dispute settlements.To build a public-interest mediation mechanism for rural disputes,firstly,it is necessary to select and hire various talents as mediators to overcome the difficulties such as the lack of professional knowledge and limited experience;secondly,it is necessary to connect dispute cases with corresponding mediators in time,and form a dynamic dispute mediation system by setting a rural dispute mediation platform,making a roster of various professional mediators,and listing types of rural dispute cases,so as to timely mediate and resolve increasingly complex rural disputes;thirdly,it is necessary to clarify the public-interest orientation.By reducing the cost burden of villagers,saving time and energy,and improving villagers’expectations,it is helpful for villages to have the mediation as their priority choice in disputes resolution.
