摘 要:我国涉外民商事协议管辖制度目前仍然保留实际联系原则,用以维护司法主权并保护弱者利益。然而现实表明,实际联系原则的上述功能与价值已被弱化,且可以被其他制度替代或者用更加直接的方式予以实现。实践中,实际联系原则解释标准的混乱等现象已引发相当数量的适用问题,同时也限制了我国法院的受案范围。从比较研究的结果看,废除实际联系原则之做法已被国际上大多数国家所认可,晚近主要的国际公约也显示了这一立场。在我国开启国际私法典编纂的背景下,应当采纳废除实际联系原则的立场,并通过合理的路径选择,完善协议管辖制度设计,推动我国国际民商事争议解决机制实现新发展。The principle of substantial connection is still retained in China’s international civil jurisdiction system to safeguard judicial sovereignty and protect the interests of weak parties.However,the reality shows its value and functions mentioned above has been weakened and can be replaced by other mechanisms or realized in a more direct way.In practice,the confusion of the interpretative standard of the doctrine has led to many problems in its application.The principle also limits the scope of accepting cases in Chinese courts.Most countries has abolished the principle and this position is also reflected in the late international conventions.In the context of the codification of private international law in China,we should adopt the position of abolishing the principle of substantial connection,improve the consensual jurisdiction system through a reasonable way,and finally promote the new development of China?s international civil and commercial dispute resolution mechanism.
