论新《行政处罚法》视域下档案行政处罚程序的完善

摘　　要：新修订的《行政处罚法》涉及行政处罚程序的规定已渐趋完善。从档案法律体系来看,新《档案法》未对档案行政处罚程序作出更为明确的规定,档案行政处罚程序规定仍主要体现在2000年发布的《档案行政处罚程序暂行规定》中。在新《行政处罚法》视域下,我国档案立法在立法规定、立法技术、制度建设、监督执行等方面存在一定滞后与缺陷。为贯彻落实新《行政处罚法》,结合档案行政处罚的立法价值与特点,建议更新完善《处罚暂行规定》,健全档案行政处罚程序,以回应依法治档的时代要求,为档案行政处罚制度的高质量发展提供法治保障。The provisions related to administrative punishment procedures in the new Administrative Punishment Law have been gradually improved.From the perspective of archives legal system, the new Archives Law does not make more explicit provisions on the procedures of archives administrative punishment, and the provisions on the procedures of archives administrative punishment are still mainly reflected in the Interim Provisions on the Procedures of Archives Administrative Punishment issued in 2000.Under the scope of the revision of the Administrative Punishment Law,China’s archives legislation has some defects on the aspects of legislative provisions, legislative technology, system construction, supervision and implementation.In order to implement the new Administrative Punishment Law and combine the legislative value and characteristics of archives administrative punishment, it is suggested to update and amend the Interim Provisions on the Procedures of Archives Administrative Punishment,improve archives administrative punishment procedures, so as to respond to the requirement of the times of managing archives according to law, and provide legal guarantee for the high-quality development of archives administrative punishment system.
