摘　　要：公民道德素养是衡量一个国家、一个社会文明程度的显著标志。长期以来党和国家始终坚持依法治国与以德治国相结合的治国方略,努力满足人民对美好幸福生活的需求和期待。然而,社会经济与道德文明的发展并不总是步调一致,随着市场经济发展与社会转型速度加快,多元化的价值取向带来了多样化的行为方式,导致社会失德现象和失范行为。民众普遍呼吁要求建立惩戒失德行为机制,加大对失德行为者的惩处力度,以此改善社会道德风气。以制度化规范形式对失德行为进行惩戒是一种积极尝试和创新,也是一种教育手段。构建有效的惩戒失德行为机制需要从价值意蕴、遵循原则与合理路径三个层面进行思考和认识。Citizens’moral quality is a significant symbol to measure the degree of civilization of a country and a society.For a long time,the party and the state have always adhered to the strategy of governing the country by combining the rule of law with the rule of virtue,and strive to meet the people’s needs and expectations for a better and happy life.However,the development of social economy and moral civilization is not always in step.With the development of market economy and the acceleration of social transformation,diversified value orientation has brought diversified ways of behavior,leading to the increasing phenomenon of social immorality and anomie.People generally call for the establishment of a mechanism to punish immoral behavior and increase the punishment of immoral behavior,so as to improve the social moral atmosphere.Punishing immoral behavior in the form of institutionalized norms is not only a positive attempt and innovation,but also an educational means.To construct an effective mechanism of punishing immoral behavior,we need to think and understand from three aspects:value implication,following principles and reasonable path.
