数据邻避:超大城市智慧建设的困局及应对

摘　　要：推进超大城市智慧建设是“十四五”时期经济社会发展的重要方向,但因智慧城市实践与社会主体的原有预期存在冲突,且未能有效平衡和兼顾各方主体利益,其负外部性不断引发社会公众担忧,产生数据邻避困局。社会风险源于制度与现实,风险不是由技术本身所造成的,而是由使用技术的主体不同所致,必须通过制度创新保障超大城市智慧建设中的空间正义。域外通过构建顶层规划、完善权利保障与明确政府功能来维护城市居民合法权利与合理利益。在吸收域外经验基础上,我国应构建系统的顶层规划,明确事前权利保障、健全事中监管机制、丰富事后救济措施,通过制度规约引导超大城市智慧建设形成多元利益共同体,推动超大城市良政善治的实现。Promoting the smart construction of mega-cities is an important direction for economic and social development in the 14th Five-Year Plan period,but because the practice of smart cities conflicts with the original expectations of social subjects and fails to effectively balance and take into account the interests of all subjects,its negative externalities continue to cause public concern and generate a data avoidance dilemma.Social risks originate from institutions and reality,and are not caused by technology itself,but are caused by the different subjects using technology.In addition,the governments’function is to protect the legal rights and reasonable interests of urban residents by constructing top-level planning,improving rights protection and clarifying government functions.On the basis of overseas experience,China should build a systematic top-level plan,clarify the prior rights protection,improve the intermediate supervision mechanism,and enrich the post-event relief measures,so as to guide the mega-city wisdom construction to form a multi-interest community through institutional regulations and promote the realization of good governance in mega-cities.
