摘　　要：检察公益诉讼是由检察机关作为国家利益和社会公共利益代表提起诉讼的一种行为活动,不干预行政机关的正常执法活动,以行政机关违法行使职权或者不作为、行政相对人违法开展生产经营活动为诉讼标的,旨在保护国家利益和社会公共利益。近日,最高人民检察院、水利部联合印发《关于建立健全水行政执法与检察公益诉讼协作机制的意见》,为推进涉水领域公益诉讼提供了依据。在司法实践中,各地应立足省情水情,加快出台配套实施细则,准确把握好涉水领域公益诉讼重点,以风险预防为原则和条件,合理运用诉前检察建议,探索引入诉前磋商机制,最大限度保护好涉水领域国家利益和社会公共利益。Procuratorial public interest litigation is an action that is initiated by procuratorial organs as represen-tatives of national interests and social public interests,and does not interfere with the normal law enforcement activities of administrative organs,with the illegal exercise of power or omission of administrative organs,or the illegal production and business activities of the counterpart as the subject of litigation,aiming to protect national interests and social public interests..The Supreme People's Procuratorate of the Peoples'Republic of China and the Ministry of Water Resources of the Peoples’Republic of China jointly issued the Opinions on Establishing and Improving the Cooperation Mechanism Between Water Resources Law Enforcement and Procuratorial Public Interest Litigations,providing a basis for promoting public interest litigation in water--related fields.In judicial practice,local authorities shall,based on the provincial conditions and water conditions,speed up the issuance of supporting implementation rules by the Opinions,accurately grasp the key points of public interest litigation in water-related fields,take risk prevention as the principle and condition,reasonably use the pre-litigation procuratorial suggestions,seek to introduce the pre-litigation consultation mechanism,and maximize the protection of national interests and social public interests in water-related fields.
