摘  要:算法个性化推荐已经融入社会生活各场景之中,基于对算法个性化推荐商业应用场景和技术逻辑、技术特征的分析可知,算法个性化推荐技术对消费者权益的损害和竞争秩序的破坏具有特殊性与规制的迫切性。在单一公法与单一私法不足以对其进行规制时,亟需竞争法来填补消费者损害救济的鸿沟。算法个性化推荐技术对消费者的损害并非单纯的法律问题,应采取多元救济模式来应对,在用好竞争法这个抓手的同时要充分发挥社会各层主体作用,并对算法本身和消费者本身分别予以技术补救和数字素养补救。Personalized recommendation algorithm has been integrated into various scenarios of social life.Based on the analysis of the commercial application scenarios,technical logic,and technical characteristics of personalized recommendation algorithm,it can be seen that it has the specialty and the urgency of regulation to the damage of consumers'rights and interests and the destruction of competition order.When a single public law and a single private law are insufficient to regulate personalized recommendation algorithm,competition law is needed urgently to fill the gap in consumer damage remedies.The damage to consumers caused by algorithm-based personalized recommendation is not just a legal issue and multiple models should be adopted for the remedy.While making good use of competition law,it is necessary to give full play to the role of the main body at all levels of the society,and provide technical remedy and digital literacy remedy to the algorithm itself and the consumer themselves.
