摘　　要：笔者介绍了创造性以及转用发明的基本概念,并且通过四个具体的案例进行分析,从化学产品结构与领域的关系、化学产品结构与预见性的关系入手,从而体现化学产品结构在转用发明创造性评判中的考量因素,为转用发明的创造性评判提供一定的实操理论基础。The author introduces the basic concepts of creativity and invention by diversion, and analyzes it through four specific cases, starting from the relationship between chemical product structure and field, and between chemical product structure and predictability, thus, it reflects the consideration of the structure of chemical products in the evaluation of the creativity of invention by diversion, and provides a practical theoretical basis for the evaluation of the creativity of invention by diversion.
