论粤港澳大湾区司法文书协助送达制度的完善

摘　　要：司法文书送达制度贯穿整个司法程序,关系着当事人能否顺利参与诉讼,相关裁判的落实执行,公平正义理念的体现。当前,由于粤港澳大湾区遵循的法系不同,缺乏统一的送达指导意见,粤港澳大湾区司法文书协助送达现状存在较多问题,“送达难”问题突出,具体表现为送达程序过于繁琐、受送达主体信息获取难、送达效率低等。建议尝试通过下放送达权限、完善现行送达方式和探索新的送达方式完善粤港澳大湾区司法文书送达协助制度,这不仅有利于粤港澳大湾区法律制度的建设,而且更能助力于将其打造成世界级城市群。The service system of judicial documents runs through the whole judicial process,which is related to whether the parties can successfully participate in the proceedings,the implementation of the relevant judgments,and the embodiment of the concept of fairness and justice.At present,due to the different legal systems followed by the Guangdong-Hong Kong-Macao Greater Bay Area,there is a lack of unified service guidance.There are many problems in the status quo of judicial instrument assistance service in the Guangdong-Hong Kong-Macao Greater Bay Area,and the problem of'difficulty in service'is quite prominent.The specific performance is that the service procedure is too cumbersome,the subject of service is difficult to obtain information,and the service efficiency is low.We will try to improve the service assistance system of judicial documents in the Guangdong-Hong Kong-Macao Greater Bay Area by decentralizing the service rights,by improving the current service mode and by devising new service methods,which is not only beneficial to the development of the legal system of the Guangdong-Hong Kong-Macao Greater Bay Area,but also helps to build up a world-class urban agglomeration.
