论行政处罚设定中被处罚行为的性质--以《惠州市停车场建设与管理办法》为例

摘　　要：规章《惠州市停车场建设与管理办法》在起草过程中,恰逢《广东省规章设定罚款限额规定》和《行政处罚法》的修改,对如何依法设定行政处罚提出了新的要求。依据《行政处罚法》《行政许可法》和《行政强制法》,设区的市在设定行政处罚时,只有针对性质为违反行政管理秩序的非行政许可和行政强制等行政法律关系行为才可以设定处罚。《惠州市停车场建设与管理办法》在起草、审核和修改的过程中,依循这个标准,对“未提交材料”设定了行政处罚。面对企业收费,最终删去了对未交纳道路停车泊位停车费设定的行政处罚。In the process of drafting the regulations of"Huizhou Parking Lot Construction and Management Measures",it coincides with the revision of the"Provisions on The Establishment of Fine Limits in Guangdong Regulations"and the"Administrative Punishment Law"as they set out new requirements on how to impose administrative punishment according to law.In the light of"Administrative Punishment Law","Administrative License Law"and"Administrative Compulsion Law",which are involved in imposing administrative punishment,a city with districts can only impose punishment for administrative legal relationship behavior that violate the administrative management order and whose nature are non administrative licensing and non administrative compulsion.In the process of drafting,reviewing and revising the Huizhou Parking Lot Construction and Management Measures,administrative puninshment are handed out for"non submission of materials"in accordance with this standard.In the face of enterprise charges,the administrative puninshment imposed for failing to pay the parking fee of road parking spaces was finally deleted.
