审判中心视野下预审职能再思考

摘　　要：预审具有监督制约、补充侦查、人权保障、诉讼准备的本体职能,但当前预审工作存在的不足或将成为法治进步的掣肘。因此,对预审的应然职能进行研判,使之适应“以审判为中心”的改革基调,不仅是作为刑事诉讼程序重要环节的预审的自身诉求,也将对全面推进依法治国背景下刑事诉讼制度的改革产生巨大助力。因此,坚持“以审判为中心”的司法制度改革理念,维护和完善预审应然具有的职能,并在公安机关内部建立适切的预审职能架构,对公安机关刑侦工作具有积极意义。Pre-trial investigation has the functions of supervision,control,supplementary investigation,human right protection and litigation preparation,however,the deficiencies of pre-trial have constituted obstacles to the progress of law governance.Therefore,to conduct research into the functions of pre-trial investigation helps it align with the reformation principle:take the pre-trial investigation as a key link.The pre-trial investigation as an important link of criminal procedure should not only do as it requires,but also acts as an impetus for promoting the reformation of the criminal procedure system under the background of comprehensively propelling the law governance.Thus,it is positively significant to police criminal investigation to stick to the notion of taking the pre-trial investigation as a key link,which is a judicial system reformation,to maintain and perfect its due functions and to establish an internal proper functional structure.
