捕诉一体背景下公安机关提高逮捕案件质量研究

摘　　要：逮捕作为最为严厉的一种强制措施,其主要目的是防止犯罪嫌疑人妨碍刑事诉讼活动,逃避侦查、起诉、审判以及发生社会危险性进而限制其人身自由,以确保侦查机关能够全面及时地收集证据,为之后的刑事诉讼活动打下良好基础。2018年最高人民检察院检察长提出:"实行捕诉合一,形成完整的、适应司法责任制需求、有助于提高办案质量的内设机构体系。"在捕诉一体背景下,检察人员能够提前介入到侦查活动,同时对侦查程序进行全方位、全时段的监督,以此加强对公安机关侦查活动的制约,确保速捕措施的合目的性。实行捕诉一体在保障了被追诉人人权的同时,亦对公安侦查工作,特别是逮捕工作提出了更高的要求。As the most severe compulsory measure,the main purpose of arrest is to prevent criminal suspects from obstructing criminal proceedings,evading investigation,prosecution,trial and social danger,thereby restricting their personal freedom,so as to ensure that the investigation organs can comprehensively collect evidence in a timely manner to lay a good foundation for subsequent criminal proceedings.In 2018,the chief procurator of the Supreme People's Procuratorate proposed:"The integraticn of arrest and prosecution will form a complete internal institutional system that meets the needs of the judicial accountability system and helps improve the quality of case handling"Under the background of the integration of arrest and prosecution,prosecutors can advance Intervene in the investigation activities,and at the same time conduct all-round and full-time supervision of the investigation procedures,soas to strengthen the constraints on the investigation activities of the public security organs and ensurethat the arrest measures are fit for purpose The implementation of the integration of arrest and prosecution not only protects the human rights of the accused,but also puts forward higher requirements for the public security investigation work,especially the arrest work.
