摘　　要：乡村革命根据地政权需要法制,但到底需要的是游击式法制还是正规法制,根据地内部为此争论不休。就表象上看,游击式还是正规,只是一种根据地政权法制建设方向性的实践问题,然而随着时间的推移,军事、政权建设方面的“游击式”逐渐成了一个无需论证的政治正确性话语,正规化则成了“教条主义”“本本主义”的代名词,争论于是演化为“政权工作中的两个根本思想问题”。所谓游击式法制,即立法简陋、司法程序简单、执法迅速等,长期如此很难实现法治的追求。在此背景下,陕甘宁边区政府以“革命法制”为目标,尝试在“游击式法制”和“正规法制”之间寻求生存空间,走出了一条“新型正规法制”的道路。这条道路,既是一种话语体系,又有一套制度样态,其影响不可不察。The regime in rural revolutionary base areas needs the legal system,but there is an endless debate within the base areas about whether it needs guerrilla-style legal system or formalstyle legal system.At the surface level,either the guerrilla-style or the formal-style is only a practical issue related to the direction of the legal system construction of the base area regimes,but within the Communist Party of China,the"guerrilla-style"of military and regime construction had gradually become a discourse of political correctness that requires no argument,but the formalization had become the synonym of"dogmatism"and"bookism",thus the debate evolved into"two fundamental ideological issues in the work of the political regime".The so-called guerrilla-style legal system means that the legislation is simple,the judicial procedures are summary and the law enforcement is rapid,etc.In the long run,it is difficult to realize the pursuit of rule of law.In this context,the government of Shaanxi-Ganjiang-Ningxia Border Region aimed at the"revolutionary legal system",struggled to seek living space between the guerrilla-style legal system and the formal-style legal system,and took a path of"new formal-style legal system".This path is not only a kind of discourse system,but also a set of institutional patterns,and its influence must be noticed.
