摘　　要：《中华人民共和国体育法》(简称《体育法》)的全面修订,标志着我国体育法治建设进入一个新的历史发展阶段,翻开全面推进依法治体的新篇章。《体育法》是我国体育领域的基础性、综合性立法,也是目前我国体育领域唯一的一部法律,在体育法体系和体育法治建设中具有举足轻重的地位和作用。《体育法》颁布实施20多年来,我国政治、经济、社会、文化都发生了巨大变化,体育事业伴随改革开放和社会主义市场经济的发展取得巨大成就的同时,也出现诸多新特点、新情况、新问题和新挑战,迫切需要通过《体育法》的修改予以解决,以推动体育改革深入发展,加快体育强国建设步伐,助力健康中国建设,实现人民对美好生活的新期待。在《体育法》修订过程中,有很多热点、争点和难点问题。结合《体育法》修改背景,以问题为导向,着重提炼《体育法》修改工作中的主要意见分歧,分析立法者对争议问题的立法考量和立法理由,以期更好地理解和把握《体育法》修改的基本思路、价值取向和重要内容,推动《体育法》的贯彻实施和体育法律法规体系的进一步完善。The comprehensive revision of Law of the People’s Republic of China on Physical Culture and Sports marked that the construction of sports rule by law in China has entered a new stage of historical development,and has opened a new chapter of comprehensively promoting law-based governance of sports.Law of Physical Culture and Sports is the basic and comprehensive legislation in China’s sports field,and it is also the only law in this field at present.It plays an important role in sports law system and sports rule of law construction.Since the promulgation and implementation of Law of Physical Culture and Sports for more than 20 years,great changes have taken place in China’s politics,economy,society and culture.With the development of the reform and opening and the socialist market economy,sports undertakings have made great achievements,but at the same time,many new features,new situations,new problems and new challenges have emerged.It is urgent to solve them through the revision of Law of Physical Culture and Sports,so as to promote the in-depth development of sports reform,speed up the pace of building a country strong on sports,and help to build a healthy China.In the process of revising Law of Physical Culture and Sports,there are many hot spots,disputes and difficulties.Based on the background of the revision of Law of Physical Culture and Sports,this paper is problem-oriented,focusing on refining the main differences of opinions in the revision of Law of Physical Culture and Sports,and analyzing legislators’legislative considerations and reasons for controversial issues,in order to better understand and grasp the basic ideas,value orientation and important contents of the revision of Law of Physical Culture and Sports,and promote the implementation of Law of Physical Culture and Sports and the further improvement of the sports laws and regulations system.
