农村商业银行股东资格管理问题探讨

摘　　要：农村商业银行股东资格管理在实务中存在着认定关联方关系和发现股权代持关系困难重重、财务数据指标真实性的判断难度较大、入股资金来源穿透审核的“度”难把握、股东资格要求中定性指标的执行尺度不准以及自然人股东资格标准存在明显漏洞等问题。据此,作者建议要重整农村商业银行股东资格管理规范、加强对穿透监管和定性指标执行的监督工作、重点推进对股东资格管理中特殊问题的专门监管以及加强自然人股东资格管理工作。In practice,there are many problems in the the management of shareholder qualification of rural commercial banks,such as difficulties in identifying the related party relationship and finding the equity holding relationship,difficulty in judging the authenticity of financial data indicators,difficulty in grasping the"degree"of capital source penetration audit,inaccurate implementation scale of qualitative indicators in the shareholder qualification requirements,and obvious loopholes in the qualification standards of natural person shareholders.Accordingly,the author suggests that we should reorganize the management of shareholder qualification norms of rural commercial banks,strengthen the supervision of penetration supervision and the implementation of qualitative indicators,focus on promoting the special supervision of the special problems in the management of shareholder qualification and strengthen the management of natural person shareholders’qualifications.
