摘　　要：为进一步研究人民币国际化背景下资本项目开放的法制路径,通过分析人民币资本项目开放的现状,指出人民币资本项目开放方面存在的法律和认知障碍。我国应发挥法律的引导和保障功能,适时以法律形式宣布人民币资本项目可兑换,并设计以人民币国际化为目标的资本项目开放次序;在此基础上,出台《资本项目开放条例》,明确规定资本项目开放的目标、原则、模式、管理措施和预警体制,并设置回弹和例外条款,以保证资本项目开放制度更好地促进人民币国际化,为必要的资本项目管制留下制度空间。In order to further study the legal path of capital account openness in the context of RMB internationalization, this paper analyzes the current situation of RMB capital account opening and points out the legal and cognitive obstacles in RMB capital account opening. China should play the function of legal guidance and guarantee, announce the convertibility of RMB capital account in the form of law at an appropriate time, and design a capital account opening sequence with the goal of RMB internationalization. On this basis, the Capital Account Opening Regulations should be introduced to clearly stipulate the objectives, principles, modes, management measures and early warning system of capital account opening, and set up rebound and exception clauses to ensure that the capital account opening system can better promote RMB internationalization while leaving institutional space for the necessary capital account control.
