专利跨国诉讼中禁诉令适用的困境与纾解

摘　　要：英美等国法院在专利跨国平行诉讼中频繁发布禁诉令,并声称禁诉令的效力只及于案件当事人而非外国法院。我国法院依据行为保全规定发布了“禁诉令”性质的行为保全裁定。与其他民商事平行诉讼不同,由于专利具有地域性的特点,在专利平行诉讼中,诉讼客体与被诉法律关系并非具有同一性,各诉讼具有独立性。因此,禁诉令在专利平行诉讼中的适用对专利的地域性、当事人诉权以及他国法院的司法管辖权等均带来重大影响,造成困境。为纾解禁诉令产生的困境,国际社会应该就禁诉令救济展开国际合作与协调。我国应维护国家司法主权原则,完善国内相关立法,保护我国当事人正当的诉讼权益,采取举措限制外国禁诉令造成的不利影响。The courts in UK,America and other countries frequently issue anti-suit injunctions in the transnational parallel litigations of patents,and claim that the effectiveness of injunctions only extends to the parties of the case rather than foreign courts.According to the provisions of act preservation,China's courts issued the act preservation of"anti-suit injunction".Different from other civil and commercial parallel litigations,due to the regional characteristics of patents,the legal relationship between the litigation object and the accused is not the same,and each litigation is in‐dependent in the patent parallel litigations.Therefore,the application of the anti-suit injunctions in the patent parallel litigations has a significant impact on the regionality of the patent,the right of action of the parties and the jurisdiction of the courts of other countries.In order to alleviate the difficulties caused by the anti-suit injunction,the international community should carry out international cooperation and coordination on the relief of the anti-suit injunction.China should uphold the principle of national judicial sovereignty,improve domestic legislation,protect the legitimate right of action and interests of Chinese parties,and take measures to limit the adverse effects caused by foreign anti-suit in‐junctions.
