海南省农村集体经营性建设用地入市流转问题研究--以文昌市为例

摘　　要：农村集体经营性建设用地入市制度改革,是“十四五”时期经济社会发展和乡村振兴的重要举措之一。2015年2月,海南省文昌市启动农村集体经营性建设用地入市试点改革。通过赋予集体所有制下的经营性建设用地更完整的土地权能并进行土地股份制改造,加强建设用地总体规划,建立职责明确、管理科学的农村集体经营体制,提高改革立法的权威性、统一性和专业性等措施,为农村集体经营性建设用地入市改革做好“顶层设计”,进一步盘活农村土地资源,促进一二三产业融合发展和增强新型农村集体经济活力,为海南自由贸易港建设和乡村振兴战略全面实施作出应有贡献。The circulation of rural collective-owned commercial construction land in the market represents one of the imperative measures for economic and social development and rural revitalization during the“14th Five-Year Plan”period.Wenchang city,Hainan province,launched a pilot reform project for such undertakings in February 2015.This reform endows collective-owned commercial construction land with more complete land rights,transforms the land shareholding system,strengthens the overall planning of construction land,establishes a rural collective management system featuring clear responsibilities and scientific administration,and improves the authority,unity,and professionalism of reform legislation.By doing so,it provides a sound top-level design for the circulation of rural collective-owned commercial construction land in the market,further revitalizes rural land resources,promotes the integrated development of the primary,secondary and tertiary industries,and vitalizes the new rural collective economy.Hence,this reform is of great significance to the construction of Hainan Free Trade Port and the full implementation of the rural revitalization strategy.
