社会治理现代化下的刑法与刑法修正探析——以《刑法修正案(十一)》为视角

摘　　要：在社会转型过程中,刑法的功能定位也发生着相应的变化,社会治理对刑法规范的需求与日俱增已无争议。刑法作为社会治理手段的特征逐日凸显,因此需要在社会治理的整体视角下来检讨与反思刑法本身的制度性转型。在社会治理背景下,对刑法进行规范供给,需要思考的是以什么方式甄别真正的刑法规范需求,进而评价刑法参与社会治理的效果与效益。《刑法修正案(十一)》以立法的方式进行了刑法规范供给的扩充,其中不乏争议点,对此有必要以社会治理为视角对其进行实质性的检视。同时以体系性、类型化水平等为角度对其进行规范供给水平的评价,探索社会治理现代化语境下刑法的应然定位。In the process of social transformation, the functional orientation of criminal law is changing accordingly, and the demand of social governance for criminal law norms is increasing as well. As the characteristics of criminal law as a vital mean of social governance are also highlighted, it is necessary to review and reflect on the institutional transformation of the penal system. In the supply of criminal norm under the background of social governance, we need to think about how to identify the real demand of criminal law norms, and then evaluate the effect and benefit of criminal law participation in the process of social governance. The Amendmen t Ⅺ to the Criminal Law has expanded the supply of criminal norms through legislation, which remains controversial and needs to be examined in a substantive way from the perspective of social governance. At the same time, it is of the utmost importance to evaluate the supply level of the criminal norm from the aspects of the system and categorization of modernization of national governance, and explore the position of the criminal law in the context of the social governance modernization.
