论党内法规的四重定位

摘　　要：党内法规与中国共产党从建党到革命、建设、改革与新时代实现“中国之治”的百年征程相伴相随,并不断发挥国家法律无法取代或容纳的治理伟力,超越域外法治思辨的制度想象。如何定位党内法规,更应是呈现而非定论的过程,故而在观念上无需追求以既有理论直接实现充分解释,在方法上则要开拓理路、多向为功。结合党内法规学理论体系可以作出四重定位,其逻辑理路在于:以属性定位结合本体论,先行纵览党内法规如何存在及其表征;以功能定位结合制度论,进而勘探党内法规为何存在及其建设的底层逻辑;以精神定位结合价值论,对比观察党内法规能而其他制度不能的优势所在,即党的精神浸润;以场域定位结合运行论,现实考量党内法规在不同场域的角色与特性,并铺设其运行与完善之路。由此,形成由外到内、由形而上到形而下的对党内法规进行认识、评价与把握的整体呈现。The Inner-Party Rules and Regulations go hand in hand with the CPC’s Centennial journey from the founding of the Party to the realization of “rule of China” in revolution, construction, reform and rejuvenation, and constantly give play to the governance power that cannot be replaced or accommodated by national laws, surpassing the institutional imagination of extraterritorial speculation on the rule of law.How to locate the Inner-Party Rules and Regulations should be a process of presentation rather than a final conclusion. Therefore, there is no need in concept to pursue the direct inclusion of the existing theories,instead to open up a rational way and work in multiple directions in method. Combining the theoretical system of Inner-Party Rules and Regulations, we can make a fourfold orientation, of which the rationale is that: first, we can overview the existence and characterization of Inner-Party Rules and Regulations with the attribute orientation and ontology;second, we explore the underlying logic of the existence and construction of Inner-Party Rules and Regulations, with the combination of functional orientation and institutional theory;third, combining spiritual orientation with axiology, we compare and observe the advantages of Inner-Party Rules and Regulations over other systems, that is, the infiltration of the Party’s spirit;and fourth, combining field orientation with operation theory, we consider the roles and characteristics of Inner-Party Rules and Regulations in different fields, and pave the roadway of its operation and improvement. Therefore, an overall presentation is formed of understanding, evaluating and grasping the Inner-Party Rules and Regulations from outside to inside and from metaphysical to physical.
