掣肘与突破:我国社区矫正检察监督的制度省思

摘　　要：社区矫正检察监督是刑事执行检察工作的重要内容,也是保障社区行刑依法进行的重要手段。从司法实践看,社区矫正检察工作存在监督力量有待强化、“新”自侦权备而不用、异地检察监督缺位等现实困境,严重掣肘着制度的良好运行。追根溯源,这与其传统的资源配置模式、滞后的智慧化发展水平、缺失的协同性监督理念等不无关系。应当从内部和外部两个方面优化社区矫正检察监督资源配置,利用区块链和人工智能技术发展社区矫正智慧监督新方式,发挥检察机关“新”自侦权价值以及推动社区矫正跨区检察监督制度形成等方面予以完善,不断优化检察监督机制,以实现我国社区矫正制度的法治化发展目标。The procuratorial supervision of community correction is an important component of the criminal execution procuratorial and also an important means to ensure the implementation of the community execution according to law.However,from the perspective of judicial practice,there are some practical difficulties in community correction procuratorial work,such as supervision force to be strengthened,the rarely-used“new”self-investigation power,and the absence of cross-district procuratorial supervision,which seriously hinder the good operation of the system.Through analyzing the cause of these problems,we should allocate the procuratorial supervision resources from both internal and external aspects,use blockchain and artificial intelligence technology to develop new ways of wisdom supervision,play the value of self-investigation power and form cross-district procuratorial supervision system in order to optimize the procuratorial supervision mechanism.
