健全我国数字经济下的消费者权益保护制度

摘　　要：伴随数字经济发展带来的消费者权益保护新问题不容忽视。新的商业模式、技术应用和消费形态,使传统消费领域的问题有了新表现,也使原有监管和保护缺陷被进一步放大,并不断催生新的消费纠纷类型。当前,国内外在规范新商业模式、引导新技术向善、提升用户维权能力和新监管能力方面积极探索有益经验。为更有力地应对数字经济下消费者保护工作挑战,我国应以提高消费环境安全度、经营者诚信度和消费者满意度为目标,从综合规范、特别规范和专项问题治理等多维度健全规则体系,从组织机制、引导惩戒、技术手段等多方面完善配套管理机制,营造数字消费良好生态。With the development of digital economy,some new problems concerning consumer’s rights protection can not be ignored.The new business model,technology application and consumption patterns have brought new manifestations to the problems in the traditional consumption field,further magnified the defects of the original supervision and protection system,and constantly gave birth to new types of consumption disputes.At present,both at home and abroad are actively exploring useful experience in standardizing new business models,guiding new technologies to the good,and improving users’rights protection ability and new supervision ability.In order to respond more effectively to the challenges of consumer protection under the digital economy,China should aim at improving the safety of the consumption environment,the integrity of operators and consumer satisfaction,improving the rule system from multiple dimensions such as comprehensive norms,special norms and special problem management,and improving the supporting management mechanism from the organizational mechanism,guidance and punishment,technical means and other aspects,so as to create a good ecosystem of digital consumption.
