摘　　要：基于违法信息的医疗机构不良执业行为记分具有附随性、依法性、客观性,且以数字化形式表现了行政累犯责任模式,与信用监管的合法、客观、必要和审慎原则相契合,两种制度的目标与功能都包含增加违法成本、降低执法成本和交易性成本,预防违法行为再次发生。不良执业行为记分以量化的形式体现了医疗机构一定周期内违法违规的严重程度,基于记分结果,可直接实现对医疗机构一定时间内执业行为的综合考量。但信用评价并非经典意义上针对医疗机构行为的合法性评价体系的简单重复,而是具有极强的独立意义与运行方机制。由政府背书的信用信息一旦公示带来的商誉影响更大,信用监管制度法定化要求更高。以违法执业信息为核心的医疗机构信用评价规则和以不良执业行为记分为核心的医疗机构信用评价规则都是围绕医疗机构违法执业行为展开,可根据医疗机构不良执业记分制度及其信息系统基础的完善情况,选择性实施。The scoring system on medical misconducts based on law violation information for medical institutions is attached,legal and objective,and it shows the responsibility model of administrative recidivism in digital form.It is also consistent with credit supervision in terms of legality,objectivity,necessity and prudence principle.The aims and functions of the scoring and credit supervision systems both include increasing the costs of violation of the law,reducing the costs of law enforcement and transaction,and preventing the recurrence of law violation.The scoring system on medical misconducts can quantitatively reflect the severity of the violation of medical institutions during a certain period.Based on the scoring results,the practices of medical institutions can be directly and comprehensively considered.However,credit evaluation is not a simple repetition of legitimacy evaluation in the classical sense,it has a strong independent significance and operating mechanism.Once the credit information endorsed by the government is publicized,it will have a greater impact on goodwill,and this results in higher legalization requirements for credit supervision system.The rules of credit evaluation for medical institutions are carried out around the law violation,whether the core is with law violation information or is with medical misconducts.The choice of rules of credit evaluation can be selectively implemented according to the improvement of the scoring system on medical misconducts and the development of its information system.
