坚持抓住“关键少数”的法理底蕴与实践导向

摘　　要：习近平法治思想明确了领导干部这个“关键少数”在全面推进依法治国中肩负的重要责任和时代使命,深刻阐述新时代加强公权力监督的重要意义,形成了依法治国坚持抓住“关键少数”的重要论断。深入学习、研究并在实践中贯彻落实这个论断,需要厘清“关键少数”的范围,了解“抓住”“坚持”的基本内涵,明确其理论基础、法律文化底蕴和实践导向。革命法律权威论和社会公仆思想、人民监督政府打破历史周期律等思想是坚持抓住“关键少数”的理论基础。抓住“关键少数”论断既是马克思主义法治理论中国化的最新成果,也是对世界法治理论的创新性发展,更是对中国优秀传统治国文化的创造性转化,具有深厚的法律文化底蕴。“关键少数”在我国法治建设中已经发挥了关键作用、当前领导干部推进依法治国的本领有待提高、滥用职权等违法犯罪现象仍然为数不少,是抓住“关键少数”论断的实践依据。发挥好领导干部在依法治国中的关键作用、防止“关键少数”滥用权力破坏法治,是抓住“关键少数”论断两个基本的实践导向。Xi Jinping Thought on the Rule of Law has clarified the important responsibility and era mission of the"key minorities"of leading cadres in comprehensively promoting the rule of law,profoundly expounded the significance of strengthening the supervision of public power in the new era,and formed an important conclusion that the rule of law adheres to seizing the"key minorities".To deeply study and implement this conclusion in practice,we need to clarify the scope of"key minorities",understand the basic connotation of"seizing"and"adhering to",and clarify its theoretical basis,legal culture and practical orientation.The theory of revolutionary legal authority,the thought of social public servants and the thought of people supervising the government to break the law of historical cycles are the theoretical basis for persistently seizing the"key minorities".Seizing the"key minorities"thesis is not only the latest achievement of the Sinicization of Marxist theory of the rule of law,and the innovative development of the world theory of the rule of law,but also the creative transformation of China′s excellent traditional culture of governing the country,which has a deep legal culture.The"key minorities"has played a key role in the construction of China′s legal system.At present,the ability of leading cadres to promote the rule of law needs to be improved,and there are still a large number of illegal and criminal phenomena such as abuse of power,which are the practical basis for seizing the"key minorities"thesis.Giving full play to the key role of leading cadres in governing the country according to law and preventing the abuse of power by"key minorities"from undermining the rule of law are the two basic practical guides to grasp the"key minorities"thesis.
