摘　　要：消费者评价数据是由消费者、平台经营者和平台内经营者共同贡献形成的公开型原始数据,利益格局较为复杂。消费者评价数据是平台经营者的基础性资源,平台经营者可控制消费者评价数据收集至使用的全过程,应承认平台经营者享有财产利益,并优先采用法益模式进行保护。消费者评价数据既是消费者表达自由的延伸,又是助推消费者决策和公权干预的重要工具,但消费者对其通常不享有财产利益,且难以控制,出于保护消费者权益和促进消费者评价信息传播的需要,宜赋予消费者对消费者评价数据的可携带权。消费者评价数据是平台内经营者声誉的重要载体,平台内经营者享有一定的财产利益,但现行法律制度不足以对其提供保护。出于避免“锁定效应”和应对“冷启动”问题的需要,亦宜赋予平台内经营者对消费者评价数据的可携带权。Consumer review data is an open original data made by the joint contributions of consumers,operators within the platform and operators of the platform,and the pattern of interests on such data is relatively complicated.Consumer review data is the basic resource of platform operators.Platform operators can control the whole process from collection to use of consumer review data.They should be recognized to enjoy property interests and given priority to legal interest mode for protection.Consumers review data is an extension of the freedom of expression and the important tool of boosting consumers'decision and public power's intervention,but consumers generally do not enjoy the property interest and it's hard for them to control the data.Consumers should be given the right to data portability to protect their rights and interests and to meet the need of information dissemination of consumer review.Consumer review data is an important carrier of the reputation for operators within the platform who have a certain property interest,though not enough under the current legal system.For avoiding"lock-in"effect and handling the problem of"cold start",operators within the platform also should be given the right to data portability.
