摘　　要：医疗事故频发导致医患关系紧张,也增加了医护人员的职业风险。我国目前也在积极推行医疗责任强制保险,力求在平衡医患关系的同时,对医疗服务提供者给予必要的职业保障。新颁布施行的《中华人民共和国医师法》也明确要求医疗机构应当参加医疗责任保险。澳门特别行政区先后出台《澳门医疗事故法》与《澳门医疗责任保险法》,明确规定医疗责任保险是一种医疗强制保险,且详细规定了医疗责任保险的承保范围与例外状况,以及责任限额等内容。文章提出在完善我国医疗责任保险制度时,可参考澳门特别行政区的有益探索和相关规定,如确立医疗责任保险的强制性、建立一整套医疗责任保险法律制度体系以及保险业监管机关与医药行业主管机关的双重监察机制等。The frequent occurrence of medical malpractice leads to a tense relationship between doctors and patients,and it also increases the professional risk of medical staff.At present,China is also actively implementing compulsory medical liability insurance,striving to provide necessary professional protection for medical service providers while balancing the doctor-patient relationship.The newly promulgated Law of Medical Practitioners of PR China also clearly requires medical institutions to participate in medical liability insurance.Macao SAR has successively promulgated the Macao Medical Malpractice Law and the Macao Medical Malpractice Liability Law,which clearly stipulates that the medical liability insurance is a kind of medical compulsory insurance,and stipulates in detail the coverage and exceptions of medical professional liability insurance,as well as its limits,etc.When improving the medical liability insurance system of Chinese mainland,it refers to the useful explorations and relevant regulations of Macao,such as establishing the compulsory medical professional liability insurance,formulating a whole set of medical liability insurance legal system and the dual supervision mechanism of the insurance regulatory authority and the pharmaceutical industry competent authority.
