摘　　要：将县级人民政府部门依法享有的行政处罚权“交由”乡镇人民政府、街道办事处行使,是对行政执法重心下移的明确宣示,由此引发的执法风险需要基层司法妥善处理依法审判与诉源治理、监督行政与助力行政之间的辩证关系。面对行政机关围绕行政处罚不确定法律概念展开的具体化活动,法院应坚持有限尊重和必要审查并行的基本立场,丰富行政处罚目的性解释和体系性解释的审查技术。在行政处罚立法从合法性控制向适当性保障迈进的新时代,法院应发扬法理相融、公私衡平行政裁判说理模式的优势,促进行政处罚宽严相济、基层社会良法善治局面的实现。To “hand over”the administrative penalty power held by the county-level people’s government departments to the township people’s governments and subdistrict offices is a clear declaration of the downward shift of administrative law enforcement focus.The resulting law enforcement risk requires the grassroots judiciary to properly handle the dialectical relationship between trial according to law and governance of litigation source, supervision administration and assistance administration.Facing the specific activities of administrative organs around the uncertain legal concept of administrative penalty, the court should adhere to the basic position of limited respect and necessary review, and enrich the review techniques of purposive interpretation and systematic interpretation of administrative penalty.In the new era of administrative penalty legislation moving from legitimacy control to appropriateness guarantee, the court should carry forward the advantages of the mode of jurisprudence integration, public-private balance of administrative adjudication and reasoning, and promote the realization of the situation of tempering justice with mercy and good governance of good law in grassroots society.
