摘　　要：在严峻的人口老龄化挑战下,家庭养老仍然是我国养老的主要载体。家庭财产是家庭养老的基础与保障,决定家庭养老的实现程度与水平。然而我国《民法典婚姻家庭编》及相关法律规范对家庭财产的内涵界定并不清晰,同时我国家庭财产的相关规则存在一定的法理紊乱,直接影响到家庭财产规则与《民法典》其他财产规则的协调性和社会适配性。父母为婚后子女出资购房的财产向下代际转移以及用于赡养老人的财产向上代际转移的不平衡性也不利于家庭养老功能的实现。在此特定的社会历史条件下,需要坚持财产法规则与亲属法伦理规则的良性互动、强调“家”原则对个体主义的适度修正、制定与完善家庭财产制度以保障弱势群体之老年人财产权益与高质量家庭养老功能的实现。Under the severe challenge of population aging,home-based elderly care is still a main form of elderly care.As the foundation and guarantee of home-based elderly care,family property determines the realization degree and level of home-based elderly care.However,the connotation of family property is not clearly defined in the Marriage and Family Part of the Civil Code of the People’s Republic of China and relevant legal regulations,and there are some jurisprudential disorders in the relevant regulations concerning family property in China,which directly affects the coordination and social adaptability of family property regulations with other property regulations of the Civil Code.The imbalance between the property transfer from parents to the next generation to purchase of a house for the married children and that for the support of the elderly by the next generation impedes the function realization of home-based elderly care.Under this particular socio-historical condition,it is necessary to stick to the benign interaction between the regulations of property law and the ethical regulations of kinship law,emphasize the“family”principle to moderately modify individualism,and formulate and improve the family property system to protect the property interests of the elderly of vulnerable groups and realize the function of the high-quality home-based elderly care.
