摘　　要：医疗责任保险具有转移医疗风险、保护医患双方合法权益,缓解医患矛盾的功能。文章通过梳理北京、深圳和宁波实施医疗责任保险制度的发展现状与现行措施,发现国内的医疗责任保险主要存在以下问题:强制性不足,投保积极性低,医疗责任保险设计不够合理,缺乏数据及人才。文章进而结合美、英、德三国医疗责任险的发展模式,以及我国医疗责任保险的实际情况,总结得出改进我国医疗责任保险制度的4项可借鉴措施:将强制购买医疗责任保险作为发展方向,提高医疗机构和保险公司合作的广度及深度,建立医疗责任事件数据库,以及大力培养专业人才。Medical liability insurance has the function of transferring medical risks,protecting the legitimate rights and interests of both doctors and patients,and alleviating conflicts between doctors and patients.By combing the current development status and current measures of implementing medical liability insurance systems in Beijing,Shenzhen and Ningbo,this article finds that the main problems of medical liability insurance in China are as follows:insufficient compulsion,low enthusiasm for insurance,unreasonable design of medical liability insurance,and lack of data and talents.The article further combines the development models of medical liability insurance in the US,UK and Germany with the actual situation of medical liability insurance in China,and concludes that there are four measures that can be taken to improve the medical liability insurance system in China:making the purchase of medical liability insurance compulsory as the direction of development,increasing the breadth and depth of cooperation between medical institutions and insurance companies,establishing a database of medical liability incidents,and vigorously training professional talents.
