摘  要:《中华人民共和国环境影响评价法》(以下简称《环评法》)实施已近20年,但仍存在较多违反环评制度的行为。中央生态环境保护督察过程中发现了一批与环境影响评价相关的典型案例。对中央生态环保督察典型案例中违反环评制度的行为进行分类分析可见,违反环评制度的行为主要集中体现为六种情形,且具有隐匿性和主体多元性的特征。各地或企业的中央生态环境保护督察整改方案也屡次提及环评制度。鉴于此,建议进一步修订《环评法》,完善环评信息公开制度,强化主体法律责任。Environmental Impact Assessment Law of the People’s Republic of China(EIA Law)has been implemented for around 20 years,but many violations are still concerned with it.A number of typical cases related to EIA were found in the process of Central Eco-Environmental Protection Inspection.By classifying the behaviors violating the EIA system in the typical cases of Central Eco-Environmental Protection Inspection,it can be seen that the behaviors are concentrated in six main categories,which have the characteristics of concealment and pluralism.The EIA has also been repeatedly mentioned in the rectification plans of Central Eco-Environmental Protection Inspection in various areas and enterprises.In view of this,it is suggested to further amend the EIA Law,to promote the EIA information disclosure system and strengthen the legal responsibility of the subject.
