摘　　要：法秩序统一性原则是司法裁判必须遵循的辅助性原则,该原则不仅构成裁判说理的有益“论证公式”,也是源于恪守司法德性、落实裁判义务、维护宪法价值和尊严等现代法治基础命题的法理设计。法秩序统一性原则的规范要求在意义结构上具有层次性,其既表征为排除上下位规范的效力矛盾,也呈现为排除同位阶规范的适用矛盾和排除关联性规范的价值判断矛盾。法秩序统一性原则的司法应用须依附“构成要件—法律后果”评价结构。构成要件评价应以法的行为规范属性为出发点,通过先行排除相关规范间的效力矛盾、适用矛盾和价值判断矛盾,再判定案件事实能否为构成要件所涵摄。法律后果评价须先行排除相关规范间的效力矛盾和适用矛盾,继而以法律后果的法秩序均衡性为导向,审慎决定具体法律后果的分配。The principle of unity of legal order is an auxiliary principle that must be followed in judgment,which not only is a useful “argument formula”,but is jurisprudential design stemming from the modern basic propositions of the rule of law,such as abiding by judicial virtue,implementing judicial obligations,safeguarding constitutional values and dignity.The normative requirements of this principle have hierarchical structure,which includes the exclusion of the contradiction of the validity of the upper and lower norms,of the application of norms of the same level,of the value judgment of the related norms.The judicial application of it must be based on the evaluation structure of “constituent element-legal consequence”.The former shall take the attribute of code of conduct of the law as the start,and then decide whether the case facts can be submitted by the constituent element by first eliminating the contradiction of validity,application and value judgement among the relevant norms.The latter needs to exclude the contradiction of validity and application among relevant norms,and then determine the distribution of specific legal consequences according to the balance conception prudently.
