互联网公共治理方式转型的行政行为法回应

摘　　要：传统以政府为主导的行政方式经由主体与技术改造,正从倚重单向度的刚性监管、依赖人工和时空条件,向重视包容与效能、协商互动与技术应用等方向演变,但我国行政行为法对此回应阙如。互联网时代公域变迁引发的利益基础、权力结构变动和行政任务拓展等,迫切需要推动行政行为法功能的反思与调适。强制性行政方式的滥用及其对比例原则的僭越,协商型行政方式未跳脱“中心—边缘”结构,及技术化行政方式的规范缺位,暴露了行政行为法治系统与互联网公共治理实践的脱节。应通过推进强制性行政方式适用范围限缩及合比例规制,协商型行政方式类型化及合目的性调整,技术化行政方式的分类规范等路径,助推行政行为法完善发展,提升互联网公共治理的规范化和有效性。The development of the internet has promoted the transformation of the mode of public governance.The traditional government-led administrative method is transformed by the principal part and technology.It is evolving from focusing on unilateral rigid supervision and relying on artificial and space-time conditions to focusing on inclusiveness and efficiency,negotiation and technology,but our administrative act law never response to the trend.Facing the benefit basis,power structure changes and administrative tasks expansion caused by the changes of the public domain in the internet era,it is urgent to promote the reflection and adjustment of the functions of the administrative act law.Abuse of compulsory administrative methods and compulsory methods violate the proportionality,negotiated administrative methods have not been escaped from the “center-edge” structure,and the lack of regulation of technical administrative methods,exposes the depart between the administrative act rule of law system and the internet public governance.By promoting the restriction of the scope of application of compulsory administrative methods and the proportional regulation,the formalization and purposeful adjustment of negotiated administrative mode,the classification adjustment of technical administrative methods should be used to promote the development of the administrative act law,and to improve the normalization and effectiveness of internet public governance.
